Under no circumstances should anyone ever enter into anagreement to lease a horse without the terms being carefully documented. From both the lessor%u2019s and the lessee%u2019s perspective, awritten lease agreement must detail with reasonable specificitythe terms of the arrangement. Having the terms spelled out in aproper contract ensures that both parties%u2019 interests are protectedand helps to avoid the possible fall out from any disputes thatmay arise. Below is a list of several points that may justify considerationwhen putting together an equine lease agreement depending onthe circumstances:%u2022 Term: How long will the lease be in effect for? Will it be fora year or run month to month? Can it be renewed? If so, forhow long?%u2022 Leasing Fee: How much does the lessee pay to lease thehorse? What does the leasing fee cover? When is the fee to bepaid and how is it to be delivered to the lessor? Is the lessee required to provide a deposit, and if so, how and when is it refundable?%u2022 Expenses: Who covers expenses associated with the horse%u2019scare? Board, vet bills, shoeing costs and other expenses associated with the horse%u2019s care should be specifically called out andallocated in a lease agreement. You should also consider if thelessee is responsible for any expenses after the lease term expires,and if so under what circumstances? For example, if the horsesustains an injury while in the custody of the lessee and that injury requires treatment beyond the term of the lease, who is responsible for that cost.%u2022 Rights: Define what the lessee can do with the horse. Canit be taken off of the property where it is kept, and under whatcircumstances? May it be shown? Etc.%u2022 Insurance: Is the lessee required to maintain insurance onthe horse during the lease term? What are the required limits?Who is named as the policies%u2019 beneficiary?%u2022 Responsibilities: Is the lessee required to worm the horseand schedule routine care or is that the lessor%u2019s responsibility?Is the lessee required to groom or tend to the horse in any particular way? If the horse is shown, is the lessee required to accredit ownership or allocate earnings to the lessor?%u2022 Prohibitions: Is there anything the lessee may not do withthe horse or certain times that the lessee may not have access tothe horse? %u2022 Venue & Remedies: How is it handled if one party breachesthe agreement? Particularly if the lessee and lessor are in different states, you must also dictate what jurisdiction%u2019s laws apply.If you have horses you want to lease out or you are interestedin leasing a horse, you should spend the time to put together acontract that will adequately address the situation. For most,our horses are among our greatest investments both financiallyand emotionally. Failure to define the terms of an arrangementwhereby you will entrust someone else with your horse or be entrusted with the use of someone else%u2019s horse can result in costlyand heartbreaking consequences.
